The Trump administration is not waiting, he will restore the rates without a Supreme Court reversal

The Trump administration is not allowing the Supreme Court to reverse its tax strategy. The nation’s top trade official says the White House won’t wait for Congress to restore the program.
In a 6-3 decision last week, the high court overturned President Donald Trump’s worldwide powers under the International Emergency Economic Powers Act (IEEPA). Democrats hailed the Supreme Court’s decision as a victory, arguing that tariffs raise prices for Americans every day.
But US Trade Representative Jamieson Greer said that while he was “disappointed,” it was not the end of the tariffs, adding that he did not plan to wait for Congress to re-establish the program. He mentioned that although some members of Congress have promised to work with the White House, the administration has other strategies.

“I’ve had members of Congress come to me to express interest in that, and I’m happy to continue those conversations,” Greer said on the Fox News Rundown podcast.
“But I’m not [going to] wait for that to re-establish the president’s tax plan,” he added.

Greer said the Trump administration is “very confident” the plan can be rolled back within months. He confirmed that they are referring to existing authorities, such as Section 301 and Section 232, to initiate investigations targeting unfair trade practices and threats to national security.

“We are very hopeful that in the next few months we can re-establish through this investigation, prices to address the challenges identified by the president,” Gerer told FOX News Audio White House Jared Halpern.

During his speech on Tuesday, Trump criticized the decision of the Supreme Court, calling it “a great misfortune” and saying that this program brings money to the country.

Gerer confirmed that no foreign countries have called on the United States to withdraw from trade agreements, but asked for clarification.

“It is not in the interest of these countries to cancel the agreement because their car prices are going up, all these other things. Therefore, I can say that it was a very constructive discussion,” said Gerer.

Taxes have become a signature feature of Trump’s second administration. In 2025, the president declared the country’s trade deficit a “national emergency,” arguing that the IEEPA gave him broad tax authority.
In response to the Supreme Court’s decision, the president wrote on Truth Social that he would raise the global tax rate to 15%.
